When you instruct a legal aid lawyer, there are strict limits on the amount of chargeable time they can spend working on your case. This means you will likely only receive the “bare minimum” service, regardless of how serious the allegations against you are. For example:

  • A legal aid lawyer who is a partner in a firm or very senior solicitor will not generally attend the police station, especially not out of hours.   • Client was at a nightclub with a number of Premier League footballers and the alleged victim believed the client was also a footballer. Having spent the night with him and on finding out he was not a footballer, she made an allegation of rape to the police. Following a trial at which the client gave evidence he was found not guilty.

  • Client was arrested for rape, other sexual offences, false imprisonment and threats to kill. lt was alleged by the victim that her boyfriend had failed to repay a loan to the client who had allegedly committed the offences in order to scare her boyfriend into repaying. Following a 14-month investigation the police confirmed that no further action would be taken against the client.

Sexual assault
